Software License Agreement

This Software License Agreement (“Agreement”) is a legal contract between you (either an individual or a corporate entity, hereinafter “Licensee”) and Eveterm OÜ (“Licensor”). By installing, copying, or otherwise using onArcade (the “Software”) or its associated Game Packs, you agree to be bound by the terms of this Agreement.

1. Grant of License

Licensor grants Licensee a non-exclusive, non-transferable license to install and use the Software on a single installation, accessible via one (1) unique URL (web address).

• Anti-Circumvention: Any modification to the Software or its database intended to circumvent the “one-license-per-installation” rule is strictly prohibited.
• Domain Transfers: The license may be transferred from one domain to another only within the first twelve (12) months following the initial purchase. After this period, a new license must be acquired for any new domain.

2. Ownership and Intellectual Property

The Software is licensed, not sold. All title and intellectual property rights in the Software remain the property of Eveterm OÜ.

• Game Packs & Feeds: Access to Game Packs or Feeds does not grant ownership of the individual games. All games remain the copyrighted property of their respective owners.
• Prohibited Use: The Software may not be used for any activity that infringes upon the intellectual property rights of others, including but not limited to copyrights, trademarks, patents, or software piracy.

3. Transfers and Third Parties

• Individual Use: You may not rent, lease, sub-license, sell, or assign the Software to any third party without prior written consent from Eveterm OÜ.
• License Transfer: You may transfer your license to another party via the official “Clients Area” provided by Licensor.

4. Software Modifications and Support

Licensee is permitted to alter the Software source code at their own risk. However, Eveterm OÜ does not provide technical support for any installation that has undergone third-party modifications, including changes to core code or templates.

5. Refund Policy

We stand behind our products. If you are unsatisfied with the Software for any reason, we offer a 30-day money-back guarantee.

• No Questions Asked: You are entitled to a full refund within thirty (30) days of your original purchase.
• Requirement: Upon receiving a refund, you must immediately uninstall the Software and destroy all copies in your possession.

6. Distribution Restrictions

Licensee is strictly prohibited from distributing or redistributing onArcade Game Packs to any third party or public repository.

7. Termination

This Agreement remains effective until terminated.

• By Licensee: You may terminate the license at any time by uninstalling the Software and destroying all copies.
• By Licensor: Eveterm OÜ reserves the right to revoke the license immediately if any terms of this Agreement are violated.

8. Disclaimer of Warranty & Liability

• “As-Is” Basis: The Software and accompanying files are provided “As Is” without warranties of any kind, whether express or implied, including warranties of merchantability or fitness for a particular purpose.
• Content Liability: Eveterm OÜ assumes no responsibility or liability for the content hosted on any arcade powered by the Software.

9. General Provisions

Eveterm OÜ reserves the right to modify these terms at any time without prior notice. Continued use of the Software constitutes acceptance of any updated terms.
